Risk Mitigation

In the first of our series, our speakers will provide tips for managing documents and employing policies and procedures in advance of an excursion. These actions are designed to minimize the chance of detrimental impact on litigation brought after an environmental event. The presentation will also cover the ways in which a company's response to an excursion can help or hurt the defense of a later suit.

In Part II of the series, we will discuss the impact of environmental regulation on a toxic tort action, including Plaintiffs' use of compliance oriented environmental programs, the effect of violations, and the effect of settlement of regulatory disputes on the litigation.

Special Discovery Challenges

Special discovery issues involved in toxic tort actions, including the discoverability of communications and relationships with regulators, opinions of experts retained in the normal course of operation, environmental audit privileges, and information concerning ongoing operations will be reviewed in the third segment of the series. Additionally, discovery issues involved in class actions will be discussed.

Experts and Consultants

The use of testifying experts unique to environmental toxic tort actions will be the focus in the last of our four-part series. Consultants used by the company prior to the litigation, experts used by agencies, (EPA, DEP, CDC, and ATADR), causation experts, and experts to defeat class certification will be examined. The impact of Daubert on experts' opinions will also be discussed.

Registration is free and open to BCCZ clients and guests. Parking in the Oxford Centre garage will be validated.
